Abstract

Theconstructionindustryplaysapillarroleinthedevelopmentofthenational

economy,contributingspecificallytopromotingeconomicgrowth,improvingpublic

infrastructure,andsolvingtheemploymentproblemsofmanymigrantworkers.The

contractor,astheleaderoftheconstructionindustry,hasundertakenalotofengineering

projects,butbecauseoftheimbalanceofstatuswiththeowner,itoftenfacesthe

embarrassingsituationthatitisdifficulttorecoverahugeamountofengineeringreceivables.

Inordertobreakthissituation,basedontheoriginalintentionofprotectingthelegitimate

rightsandinterestsofcontractors,ourcountryhasbeenconstantlyimprovingandimproving

thesystemofprioritycompensationforconstructionprojectpricesfromtheContractLawin

1999totheCivilCodeandtheNewConstructionInterpretation(1).However,therearestill

manyproblemsintheoperationofthesystembecauseofthediversificationofthesubjects

involvedinthefieldofconstructionengineeringandthecomplexityofcreditorsrightsand

debts.Therefore,basedonthecurrentsituationofChinasconstructionindustryandrelated

judicialcases,thispaperdrawsonandcomparesforeignlegislativeprecedentstogive

suggestionsforrealizingthepriorityrightofcompensationforconstructionprojectprices.

Inadditiontotheintroduction,thispaperconsistsoffourparts.Specifically,thefirstpart

istoexplainthebasictheory.Itfirstexplainstheprerequisiteconditionsandessential

characteristicsofexercisingtherightofprioritycompensationofconstructionprojectprice,

andthenanalyzesandcomparesthedisputedtheoriesofthenatureofprioritycompensation,
