I. Basic knowledge of bill of lading
1. definition and relation of bill of lading
Marine bill of lading (Marine Bill of Lading Ocean Bill of Lading), or referred to as B/L of (Bill Lading), is one of the most important documents in international settlement. The Hamburg Rules to define the bill of lading is: Bill of lading, means a document which evidences a contract of carriage by sea and the taking over or loading of the goods by the carrier, and by which the carrier undertakes to deliver the goods against surrender of the document. A provision in the document that the goods are to be delivered to the order of the document. A provision in the document that the goods are to be delivered to the order of a named person, or to order, or to bearer, constitutes such an undertaking. Peoples Republic of China maritime law (July 1, 1993) article seventy-first: bill of lading refers to proof of the contract of carriage of goods the sea and the loading of the goods by the carrier or the carrier, and undertakes to deliver the goods Documents.
