案例描述:
业主刘某2017年7月入住西青某小区。刘某住在一楼,阳台外是开发商为美观及供业主休憩而建造的小院,由木围栏圈成,地面覆盖绿化植被。刘某盯上这个小院,趁业主刚开始入住、小区内人较少的“时机”,陆续将小院内的绿地铲除,并将木围栏替换成砖结构,再用铝合金和玻璃等将小院封闭,原本属于业主共有的休憩场所如今却成为他自己房屋的一部分。
物业工作人员巡视中发现刘某行为,发出《装修违章整改通知书》,但刘某却毫无整改表示,物业遂起诉至西青法院。物业方认为,刘某擅自铲除绿化、拆除围栏,封闭属于公共区域的小院,严重影响小区景观和公共秩序,请求法院判令刘某拆除违章搭建的全部建筑和设施,恢复小院至原貌,包括复原绿化和植被。
法院判决:
法院认为,公民的民事活动应遵守国家法律、法规及国家政策规定,不得损害社会公共利益。原告物业方系受委托进行小区物业管理的服务单位,在物业共有设施遭受侵害时,有权代表业主主张权利。一楼小院为简易围栏圈设,属共有部分,业主可合理使用,但无权改变其设施状态和用途,被告无权改变建筑外檐自行搭建附属设施供个人使用。因此,被告应承担停止侵害、恢复诉争部位原状的责任。根据《物权法》相关规定,法院一审判决:被告刘某在判决生效后10日内自行拆除其在小院围栏内搭建的构筑设施,并将围栏、绿地等恢复原状态。
