商业综合责任保险附加计算机损失除外保险条款

本保险中的财产损失是指对实体财产所造成的有形损失。

对实体财产所造成的有形损失不包括数据或软件的损毁，特别是因删除、讹误、及原结构的变化所引起的数据、软件或计算机程序的不利变化。

因此，本保险不承保下列损失：

（1）数据或软件的损失或损毁，特别是因删除、讹误、及原结构的变化所引起的数据、软件或计算机程序的不利变化，以及因此所致的营业中断损失。但因承保财产的有形损失所直接导致的数据及软件的损失及损毁不受此限。

（2）因数据、软件及计算机程序的功能、实用性、使用范围、数据访问受损所导致的损失或损毁，以及因此所导致的营业中断损失。

主险条款与本附加险条款相抵触之处，以本附加险条款为准；本附加险条款未约定事项，以主险条款为准。

PropertydamagecoveredunderthisAgreementshallmeanphysicaldamagetothesubstance

ofproperty.

Physicaldamagetothesubstanceofpropertyshallnotincludedamagetodataorsoftware,inparticularanydetrimentalchangeindata,softwareorcomputerprogramsthat

iscausedbyadeletion,acorruptionoradeformationoftheoriginalstructure.

Consequently,thefollowingareexcludedfromtheAgreement:

(A)Lossofordamagetodataorsoftware,inparticularanydetrimentalchangeindata,

softwareorcomputerprogramsthatiscausedbyadeletion,acorruptionoradeformationoftheoriginalstructure,andanybusinessinterruptionlossesresultingfromsuchlossordamage.Notwithstandingthisexclusion,lossofordamagetodataorsoftwarewhichisthe

directconsequenceofinsuredphysicaldamagetothesubstanceofpropertyshallbecovered.

Lossofordamageresultingfromanimpairmentinthefunction,availability,rangeofuseoraccessibilityofdata,softwareorcomputerprograms,andanybusinessinterruptionlosses

resultingfromsuchlossordamage.

ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthispolicy.
