万方数据 万方数据 摘要 伴随着改革开放，我国的城市化进程明显加快，我国城管执法工作也越来越突出其重 要性，城管执法的工作形势也越来越严峻。在社会现阶段，执法暴力冲突时有发生，城市 管理执法人员和流动小商贩之间的矛盾越来越突出的暴露出来，这已经成为城管执法工作 中避无可避的现实难题。而在社会主义法治建设过程中，随着我国人民法制意识的不断觉 醒，人们对城市管理执法工作的工作要求也在越来越提高，城管执法工作实行“以人为本” 的柔性执法工作方式是城管执法工作顺利进行的必须保证，而且也是建设现代社会主义法 治社会的要求。 本文首先阐述了城管柔性执法的相关概念，指出柔性执法应该包括两个概念：第一个 概念是“柔性”，第二个概念是“执法”。这两点是相辅相成的，“柔性”和“执法”这两 个概念追求的最终目的是执法公正与执法效果的统一，将法律的教育和惩罚两个功能有机 的结合了起来。“柔性”，是指在执法的过程中，应该尽力体现以人为本的人道主义关怀， 保证执法效果公平公正，进而提高人民群众对城管执法工作的满意度。“执法”，是要合理 地应用执法者的执法权，对各种违法违规现象给予相应的处罚，进而保障守法者合法权益 不受侵害。以人为本的执法方式是柔性执法的宗旨，应该采取合理有效、灵活的工作方式 达到规范维护法律法规执行的目的。本文表述了现阶段柔性执法推广遇到的困难，主要困 难有：执法人员组成、素质差别较大；城管执法立法工作滞后，执法依据不足；部分市民 法制观念淡薄，城市意识较差；社会舆论和新闻媒体的片面性报道。并以山东兖州的柔性 执法实践经验为例对柔性执法方式进行探讨。 论文中阐述了山东省济宁市兖州区柔性执法治理小摊贩的方式方法：转变观念，树立 为民服务的理念；刚柔并济，弘扬亲民执法风尚；合理规范，引导小摊贩的合法经营，规 范监督管理；主动请民监督，加强媒体宣传，提高公众认知度。 文章最后结合兖州区的实践经验，和其他地区的柔性执法措施的资料提出完善城管柔 性执法的对策和建议：加强城管队伍自身建设，提高城管素质，提高队伍执法水平和形象； 加大舆论宣传与监督，营造良好的执法环境；做好柔性执法立法工作；科学规划，引导小 摊贩进行现代化转变。 关 键 词：城管 柔性执法 以人为本 Abstract Along with our countrys urban management becomes more and more outstanding theimportance at the same time, urban management and law enforcement work situation is increasingly grim.
