我国死亡赔偿金分配规则司法实践研究

摘要

生命权是每一位公民最重要的权利，我国在建立生命权的基础上，建立了以人为中心的生命权保护体系，

但是，随着我国经济的发展，有关生命权的保障体系也出现了一些缺陷，与社会发展存在着明显的差距，

尤其是关于死亡赔偿金分配问题。在此影响下，我国司法实践中存在死亡赔偿金分配规则不明确、对近

亲属所遭受损失的认定规则不统一、没有充分保障特殊群体的利益等问题。针对以上问题，笔者建议设

立独立条款规范死亡赔偿制度、明确分配主体、分配原则和顺序。

Abstract

Therighttolifeisthemostimportantrightofeverycitizen,andChinahasestablishedahuman-

centredsystemfortheprotectionoftherighttolifeonthebasisoftheestablishmentoftheright

tolife.However,withthedevelopmentofChina’seconomy,theprotectionsystemrelatingtothe

righttolifehasalsosufferedfromsomedefectsandthereisanobviousgapwiththedevelopment

ofsociety,especiallyregardingthedistributionofdeathcompensation.Undertheinfluenceofthis,

thereareproblemsinChina’sjudicialpractice,suchasunclearrulesforthedistributionofdeath
