standardslegalsystem.China’sworkinghourssystemcanbebroadlydivided
intothestandardworkinghourssystemandthespecialworkinghourssystem.
Amongthem,themostimportantdocumentforadjustingthespecialworking
hourssysteminChinaistheNoticeonIssuingtheMeasuresforthe
ExaminationandApprovalofFlexibleWorkingHoursArrangementand
ComprehensiveWorkingHoursSchemeAdoptedbyEnterprises,whichwas
formulatedbytheformerMinistryofLabourin1994basedontheprovisionsof
Article39oftheLaborLawofthePeople’sRepublicofChina.Sinceitgrants
provinciallabouradministrativedepartmentstheauthoritytoformulate
correspondingapprovalmethodsforlocalenterprises,mostprovincesand
citiesacrossthecountryhavealsoissuedlocallegaldocumentsonthe
managementofthespecialworkinghourssystem,whichtogetherbuildthe
basicframeworkofChina’sspecialworkinghourssystem.However,giventhat
thesystemhasbeeninplaceforalongtimeandhasnotbeenrevisedsinceits
establishment,itsshortcomingsarebecomingmoreandmoreapparent,andit
isseriouslylaggingbehindthedevelopmentofsocietyandisnolongerableto
meetthecurrentneedsofsociety.In2012,theMinistryofHumanResources
andSocialSecurityofthePeople’sRepublicofChinadraftedandpublished
theRegulationsontheAdministrationofSpecialWorkingHours(Draftfor
PublicComments),withtheintentionofwidelysolicitingtheviewsofallparties
insocietyinordertoreformandimprovethesystem;unfortunately,morethan
10yearshavepassed,andthedrafthasyettomakesubstantiveprogress.
