英国法上“死亡”定义之考察 【摘要】本文从英国判例法和医学行业标准两个方面考察了英国法上“死亡”这一概念的发展过程，阐释了传统的心跳和 呼吸停止标准与脑死亡标准的关系以及英国社会目前对死亡定义所存在的疑虑和争议，并且指出了英国法对我国的借鉴意 义。本文通过对英国法上死亡定义的考察，以期对我国目前正在进行的脑死亡法的起草工作有所助益。 【关键词】英国法；脑死亡标准；传统死亡标准 【中图分类号】d90 【文献标识码】a 【文章编号】1007—9297(20xx)03-0175—06 study oll the definition ofdeath under english law．ding chun-yan．law faculty,university ofhongkong 【abstract]this article introduces the development of the definition of death under english law mainly from the perspectives of english case law and four medical pracrice codes． then it discusses山e debate on the unitary standard and the binary stan ． dard under english law， which is concerned with the relationship between the traditional standard of death and the standard of brain death．moreover，this article describes the current apprehensions of the public towards the definition of death in england．fi． nally it emphasizes three points which china may learn from english law in this field． since china is working on the draft of brain death law，this article is supposed to make some contribution． 【key words】english law，the standard of brain dea山，the traditional standard of death 作为法律事实的一种。“死亡”这一事件在不同的 部门法上会产生特定的法律效果。法律对“死亡”加 以定义的直接目的， 旨在确定特定主体的死亡时间， 从而明确因死亡而产生的特定法律效果何时得以发 生。在医学法上，死亡的定义显得尤为重要；因为它直 接关系到对下列两个问题的判断：医生何时能够对病 人停止救治。以及医生何时能够移植病人的器官。因 此．本文将考察英国法上“死亡”这一概念的发展和其 当前所面临的问题。以期对我国的相关立法提供一定 的参考价值。 一 、判例法：脑死亡标准的确立 在英国法上。至今没有成文法对死亡做出明确的 定义。按照传统理论，死亡是指某一法律主体停止心 跳和呼吸。但是自上世纪50年代起，随着医学的发 展。心跳或者呼吸停止的病人在特定的条件和医疗设 施下能够再度恢复：而心跳或者呼吸即将停止的病人 依靠特定的生命维持系统(1ife—support system1也能 够得以维持，即使这种生物体的维持可能已经失去了 治疗上的意义。于是，关于脑死亡brain death)的标准 在医务实践中获得认可．并且促使判例法对死亡的定 义做出新的认识。 在r v．malcherek和r v．steel的案件中。英国 上诉法院在认定故意伤害致死罪的时候，面临了如何 判断死亡的问题。由于医生在判定被害人脑死亡后即 关闭了呼吸机．因此被告辩称，被害人的死亡并非由 其故意伤害行为所导致：而医生则认为被害人在脑死 亡之时即已死亡。上诉法院在判决时，回避了“死亡标 准”的这个问题。而直接基于如下理由认定了被告的 罪行：医生关闭呼吸机的行为并未打破因果关系链， 因为被告的故意伤害行为“持续构成被害人死亡的有 效原因fcontinued to be an operating casue of death1”。 换句话说。被害人的死亡是由被告故意伤害行为所产 【作者简介】丁春艳(1978-．，汉族，浙江宁波人，北京大学法学学士、法学硕士，英国伦敦大学学院法学硕~(llm)，现于香港大学法学 院攻读博士学位。tel：00852—6379906
