I I 摘 要 摘 要 近些年来，有关醉酒驾驶案件屡见不鲜，醉酒驾驶的行为已经严重危害到公共安全。 不论是从新闻媒体的报道中，还是发生在我们身边的事情，醉酒驾驶问题已经越来越影 响到我们的生活。一张张血淋淋的照片，一个个悲惨的事实都提醒着我们醉酒驾驶的危 害。在社会各界的呼吁中 2011 年《刑法修正案（八）》诞生了，它的内容是在一百三十 三条交通肇事罪的后边增加了危险驾驶罪，作为一百三十三条的内容之一。此法条所规 定的危险驾驶罪主要是包括醉酒驾驶型危险驾驶罪和飙车型危险驾驶罪。本文主要是对 醉酒驾驶的情况进行的分析，主要包括五个部分。 第一部分主要介绍了我国有关危险驾驶罪的立法的背景和立法意义，以及国外有关 醉酒驾的相关的立法规定。笔者在此利用比较分析的方法，将我国的危险驾驶罪的规定 的内容与国外的立法的规定进行了比较，指出我国在危险驾驶罪的设定上存在的不足之 处。 第二部分对我国的醉酒驾驶的主客观要件进行了分析。新法对醉酒驾驶的概念规定 不够详细,对醉酒的标准的规定并没有规定，在有关醉酒驾驶的主观罪过的认定上司法 界也存在较大的争议，醉酒驾驾驶的行为人主观是故意还是过失存在不同的观点，笔者 在对其不同的观点进行介绍后提出来自己的意见。 第三部分对危险驾驶罪和交通肇事罪和以危险的方法危害公共安全罪之间的关系 进行了梳理。刑法规定的危险驾驶罪对醉酒驾驶的行为没有造成危害后果的进行了规 制，对于造成危害后果的以实际的情况分别定交通肇事罪和以为危险的方法危害公共安 全罪。这三个罪名共同构成了我国关于醉酒驾驶的刑事处罚的体系。 第四部分笔者对醉酒驾驶的处罚进行了详细的研究。对醉酒驾驶是否一律定罪处罚 的问题，笔者赞同醉酒驾驶的行为不应该一律认定为犯罪，对于犯罪情节轻微，危害不 大的不认为是犯罪。对于行政处罚和刑事处罚认定依据进行了分析，笔者认为对规制醉 酒驾驶的行为应该坚持行政处罚和刑事处罚的结合，严厉地打击醉酒驾驶的行为。 关键词 危险驾驶罪 醉酒驾驶 主观方面 交通肇事罪 处罚 II II Abstract Abstract In recent years, the cases of drunken driving frequently occurred in our life, drunken driving behavior has serious harm to public safety. Whether from the news media report, or happen all around us, drunken driving problem is getting more and more affect our lives. Some photos of terror and tragic cases remind us about the dangers of drunk driving. In 2011, “Criminal Law Amendment(Eight)” was born, the content is that at the back of the article one hundred and thirty-three traffic crime add the crime of dangerous driving crime mainly includes crime of drunken driving and chase competition driving. This paper is carries on the analysis of drunk driving behavior. It has five chapters. The first part discusses the legislation background and significance of the dangerous driving. As well as foreign related legislation about drunk driving. The author using the method of comparative analysis , compared the legislation of drunken driving behavior with of our country.
