农村集体经营性建设用地流转的研究 　　摘要：土地是我们赖以生存的地方，不能没有同时也不能再生，在经济快速发展，城市化进程的加快的背景下，我们对于土地是需求量不断增加，集体经营性建设用地流转做得好坏关系到我们未来发展的速度。本文在本着土地公有制性质不改变、耕地红线不突破、粮食生产力不减弱、农民利益不受损失的前提下，对农村集体经营性建设用地流转的必要性、演变过程和现状进行介绍，遵循党的十七届十八届会议精神，针对农村集体经营性建设用地现行法律法规和实践中存在的问题进行分析，并提出合理的建议和完善创新之处。 　　关键词：农村；集体经营性建设用地；流转 　　Study on the circulation of rural collective construction land 　　Zuo Hejun1Jinag Feiyue2Qiu Changliang1Bao Liang1Wang Guihua1 　　1. We cannot live without it and it can not be regenerated. With the rapid economic development and the accelerated process of urbanization，our demand for land is increasing，and the quality of collective construction land transfer is closely related to the speed of our future development. This paper based on the public ownership of land property does not change，do not break the grain productivity of arable land，not weaken the interests of farmers are not affected by the loss of the premise. This paper introduces the necessity，evolution process and current situation of the rural collective construction land transfer. In accordance with the spirit of the seventeen session of the eighteen session of the party，this paper will analyzed the problems existing in the current laws，regulations and practices in rural collective constructive land use，and put forward reasonable suggestions and improve innovation. 　　Key words：rural area；Collectively operated land for construction；transfer 　　1.前言 　　土地是我??赖以生存的地方，不能没有同时也不能再生，可是在社会快速发展的今天，我们对于土地是需求量不断增加，尽管说我们在土地流转中做得还可以但是还存在很多不尽人意的地方，集体建设用地流转做得好坏关系到我们未来发展的速度。新中国成立至今，我国土地所有权经历了从农民私人所有权到农民集体所有权的变化，在变化到农民集体所有权的同时，我国集体建设用地的流转问题成为我国现阶段农村土地制度改革的重点。 　　农村集体经营性建设用地流转制度还有许多方面有待完善，究其原因，即有政策方面，又有经济方面。从政策方面来讲，我国应当制定并细规范相应的法律法规，让土地流转有法可依，减少流转中出现的不必要的矛盾与纠纷，与此同时加强对土地流转的监管力度，增强对违法人员的惩罚力度，严格规范我国土地流转违法行为；从经济方面来说，经济基础决定上层建筑，我国经济市场的不完善与发展的相对滞后严重影响着我国土地流转的发展，盘活农村中存量土地资产，
