 PAGE \* MERGEFORMAT IV  HYPERLINK /link?url=k2kSAJyk5cvlJUfyUs9BGHu02q6aYZYi_FUMqzvucFAA0OlkO6ND4mMCWByGOmlM \t /_blank 兼职大学生的劳动者主体资格探讨 摘要：随着人们经济生活水平的提高，许多全日制高校的大学生，或是出于赚取生活费的目的，或是处于提高社会实践能力的目的，在业余时间里选择去各种单位兼职。大学生兼职在提高个人综合能力，增长经济收入的同时，也引发了许多个人合法权益遭到用人单位侵害的情况。针对权益受侵害的问题，如何通过法律的途径加以救济，无论在理论界，还是在实务界都未形成统一意见。要想充分地保护兼职大学生在劳动过程中的合法权益，首先要明确大学生在劳动关系中的主体资格，其次再分析“兼职大学生”劳动者主体资格在认定过程中存在的各种问题，比如我国采用的是刚性用工体制，这也决定了劳动者相关权益的保护所适用的应该是劳动法，但是目前我国劳动法当中的社保制度、用工备案制度等，都无法适用于兼职大学生；为了缓解居高不下的就业压力，国家所提倡的是大学生职业见习制度，这也导致很多大学生虽然具备劳动主体的资格，但是却无法得到劳动法的保障。最后，为了更好地解决上述的这些问题，应当在教育部的牵头之下，完善兼职大学生用工的制度，包括最低工资、每日工作时长等。 关键词：兼职大学生；劳动法；权益保护 Discussion on the main body qualification of part-time college students Abstract: with the improvement of peoples living standards, many full-time college students, or for the purpose of making a living, or in improving the social practice ability, in his spare time to choose a variety of part-time units.
