论文摘要 十九世纪末期，随着工业的蓬勃发展，工伤事故逐渐增多。为尽量降低工 伤事故所带来的人员伤害和成本损失，工伤保险制度应运而生。而经过多年的 发展，工伤保险制度仍然是社会保障体制中极其重要的组成部分。为保证工伤 保险系统能够持久地良性运行，很多国家都建立了工伤保险评估系统这一“安 全网”。 美国工伤保险评估体系建立时间较长，发展相对完善。该评估系统不仅能 为工伤保险立法改革提供各种效果评估和改进建议，还为整个工伤保险制度运 行提供了良好的监督和指导作用，在保证美国工伤保险制度平稳运行及发挥对 各利益方的保障作用中起到了至关重要的作用。 在本文中，介绍美国工伤保险评估系统的主体内容可以分为三大部分。首 先是对美国工伤保险制度的概述，主要介绍了美国工伤保险的一些基本概念， 工伤保险立法的发展历程及当前工伤保险系统的具体内容等信息。了解这部分 内容有助于更系统地认识工伤保险评估系统。 其次，文章介绍了根据评估主体的不同划分出的三大类评估体系，分别是 制度评估体系、商业评估体系和学术评估体系。制度评估是指依据政府宏观掌 控工伤保险系统状况的需求，由政府监管机构和一些非营利机构根据相关法规 条例要求所开展的评估活动；商业评估是雇主根据自身经济效益及社会效益的 需求而进行的评估活动；学术评估是专家、学者出于学术研究的需要进行的评 估活动。 最后，笔者按照评估目的的不同，将评估内容划分为五类：绩效评估、有 效性评估、经济性评估、满意度评估和资质评估，并通过典型案例对各类评估 的内容及其使用的指标进行介绍。 在文章最后，依据对美国工伤保险评估系统的分析，笔者进行归纳总结， 从思想理念、制度设计、参与主体、评估手段及工具等四个方面对我国工伤保 险制度建设提出借鉴意见。 关键词：工伤保险；评估系统；美国 1 Abstract Occupational accidents happened more frequently as the explosion of Industry in the late Nineteenth Century. In order to reduce the damage caused by occupational accidents, workers’ compensation system emerged at a historic moment. After dozens years’ development, workers’ compensation system is still an critical component of social security system. A large number of countries set up workers’ compensation evaluation system as a “safety net” to ensure the good operation of workers’ compensation system. America has set up evaluation system for workers’ compensation mechanism for a rather long time, and it’s well developed.
