分类号 分类号 密级 学校代码 学号至Q】2Q至Q巡丝 论我国罚金刑制度的缺陷与完善 On Flaws and Perfect of the Fine Penalty 研究生姓名： 黄强 指导老师姓名、职称： 刘健教授 学 科 专 业： 法学·刑法学 研 究 方 向： 中国刑法学 湖南师范大学学位评定委员会办公室 二。一五年五月 万方数据 摘要罚金刑是指由法院依法判处犯罪分子利用个人合法拥有的包括 摘要 罚金刑是指由法院依法判处犯罪分子利用个人合法拥有的包括 现金、股票、债券及其它有价证券在内的金钱向国家缴纳一定数额金 钱的刑罚方法。我国的罚金刑根源于古代社会的“赎刑”，在经历了 漫长而曲折的历史发展过程之后，于清末民初开始作为一种真正意义 上的现代刑罚制度出现在各类刑法体系之中，尤其是在新中国之后， 经过历次颁布实施的刑法草案、1979年的《刑法》和1997年的《刑 法》，最终发展成为当前我国现行刑法的重要刑罚制度之一。 在我国，罚金刑制度自从确立以后，经过一系列的发展与完善，形 成了较为完整的体系，对我国立法与司法实践具有重要意义。但受立 法技术以及其他原因，我国罚金刑制度在立法和司法实践中还存在一 些缺陷，主要表现在适用范围过窄、适用方式简单、裁量原则空置、 司法裁量失衡、执行方式单一、执行主体不明确以及执行监督机制存 在明显缺失等方面。本文通过对国外罚金刑制度的借鉴，结合我国的 实际情况，提出了具体的完善措施，主要包括：适当扩大罚金刑的适 用范围；丰富罚金刑的适用方式；建立以“犯罪情节和犯罪对象经济 状况”为主的罚金刑裁量原则；采用日额罚金制作为我国刑法体系中 的罚金刑裁量方式；增设罚金刑缓刑制度、罚金刑易科制度；建立以 法院执行庭为主的罚金判决执行主体，并建立相关的配套机制和制度 体系；建立以检察院为主的罚金刑监督机制。通过以上具体措施来完 善我国罚金刑制度，提高其执行质量与执行效率，发挥此项刑罚应有 的功能价值。 关键词：罚金刑；缺陷；完善措施 万方数据 AbstractFine Abstract Fine penalty refers to the penalty method that the criminal s are sentenced by the court to pay certain amount of money covering the legal ly owned cash，stocks，bonds and other securities to the country．The fine penalty of China can be traced to the”redemption punishment”in the ancient society． After experiencing a long and tortuous historical development， it started to appear in al 1 kinds of criminal law systems in the late Qing Dynasty and the early Republic of China as a real modern penal system．Especially，after the foundation of the new China，the fine penalty finally developed into one of the important penal system in current Chinese criminal laws after experiencing the previously enacted criminal law drafts，the ”Criminal￡a矿inLa矿 1979 and in In China，after the establ i shment，the fine penal ty system has experienced a series of development，and completion and finally forms a relatively complete system，which is of great significance to the legislation and judicial practice in China。 But due to legislation technology and other reasons，there are certain deficiencies existing in the legislation and judicial p
