论禁止使用武力规则 摘要：《联合国宪章》是人类文明和进步的成果，而禁止使用武力原则（《宪章》第 2 条第 4 款）是《宪章》的核心部分，是当代国际法和平基石，它确立了禁止在国际关系中使用武力或武力威胁原则（简称禁止使用武力原则）。然而“9.11”恐怖袭击发生后，世界上一些国家并没有从二次世界大战的惨痛教训中猛醒，特别是一些发达国家信奉“丛林原则”,世界和平受到严重威胁，而且这种危险不仅源于恐怖主义而且源于反恐战争的方式。因此虽然禁止使用武力原则已成为当代国际法的一项强行法，但也不断受到个别国家的挑战。使得这项规范成为最受争议和辩论的国际法议题之一。 关键词：战争权 禁止使用武力规则 反恐主义 自卫权 the Principle of Prohibition Use of Threat Abstract：The UN Charter is the fruit of civilization and progress of humankind, and the principle of prohibition use of threat (article 2(4) of the Un Charter) is the core of the UN Charter and the cornerstone of peace in contemporary law, Which has established the principle of prohibition of the threat or use of force (for short, the principle of prohibition of use of force). However, after the “9.11”terror attack, some countries in the world do not still awake to the painful lesson of the World War Ⅱ,especially some developed countries are embracing “the Jungle Principle”, the peace of the world is suffering the serious threat, and this danger roots not only from the terrorism but also from the way of anti-terrorism war. So, the principle of prohibition of use of law has become one item of compulsion law in the contemporary law, but it is continuously challenged by certain exceptional country, which has made this criterion become one of the most disputed and debated topic for discussion in the international law. Keywords：The Right of War the Principle of Prohibition Use of Threat Terrorism The Right of Self-defense 1国际法上使用武力规则的历史沿革 在国际法上，战争和使用武力不是同义词。首先，战争是一个法律概念，一旦爆发战争就会导致相应的法律后果；而使用武力只是一种事实，而非法律状态，只要双方进行了军事打击，就构成使用武力。其次，战争一般指发生在国家之间或者其他国际法主体之间的战斗，其主体是特定的；而使用武力的主体则较为广泛，除了国家， 非国家实体，如一个国家的某个地区、民族、叛乱团体等。最后，并非所有使用武力的情形都构成战争。所以，相对于战争，使用武力是一个更为广泛的用语。它不仅涵盖了严格意义上的战争，还包括非战争状态下的武装冲突。在人类社会发展的历史长河中，国家间的战争和使用武力是从未间断过的。国际法上使用武力规则的发展，也经历了一个从“对使用武力不加任何限制”到“全面禁止使用武力或武力威胁”的渐进过程。 1.1自由从事战争期间 在原始社会，部落之间为了争夺土地、河流等生存领域，开始发生武装冲突，从而变成原始状态的战争。从此，战争成为人类社会中不可缺少的成员。在当时，战争还是受到一定的规范，尽管这些规范还是原始的、零星的和不系统的。古印度小国纷立时，战争经常发生，出现了一些战争法规。《摩奴法典》强调指
