In our country, environmental contamination accident takes place frequently. Because environmental contamination and ecological destruction has caused many Infringement phenomena accompanied with judicial remedy problem. Judicial remedy problem becomes a great social issue. Combined with our country’s national conditions of large population base, insufficient average resources, environmental contamination and ecological destruction has a great influence on economic development and people’s life. The environmental pollution and damage has caused personal security and property damage. Therefore, the action of legislation and perfection of the tort liability law on environmental pollution and destruction is imperative. Although the environmental tort civil liability system in China has developed rapidly, its deficiencies need to be coordinated from the legislation to judicial practice, from itself to the whole law system to perfect legal environment respectively.
