城管执法论文：城管行政执法中的暴力抗法问题研究 【中文摘要】从1997年我国开始城市管理综合执法试点开始到现在已走过14个年头了,综合执法工作也从当年的试点城市向全国推进。城市管理综合执法已经成为城市管理领域的主力军,为维护城市市容环境整洁、化解社会生活矛盾、保障社会公共利益等方面做出了不可磨灭的贡献,并初步解决了城市管理领域长期存在的职能交叉、多头执法、执法扰民、管理缺位等问题。但是城市管理执法一直面临着遭遇暴力抗法的困扰。近年来,暴力抗法从数量和强度上都呈上升趋势,在社会上产生了较大的负面效应,成为城管执法工作顺利开展的一个大的障碍。如果暴力抗法问题处理不好会引起一系列的问题,不仅损害政府形象,妨碍执法人员的正常工作,还会严重影响社会的和谐,扭曲民众的法律价值观。面对这个问题我们要积极寻找解决的途径。本文立足于我国城市管理的现状,在分析城管暴力抗法的概念、特征及危害的基础之上,对城市管理过程中发生的暴力抗法行为进行了具体分析,详细阐述了暴力抗法行为发生的原因。根据工作实际经验并结合运用宪法与行政法学、城市管理相关法律法规、行政管理学等学科的基本理论和方法,提出相应解决暴力抗法的具体措施和对策。本文共分四个部分:第一部分是引言,介绍选题背景,研究现状和意义,研究思路,创新与不足。第二部分阐述了城管综合执法的概念,范围,发展过程及对城管综合执法的简要评价。第三部分介绍城管执法中的暴力抗法问题。分析了暴力抗法的概念,特征及危害性。第四部分剖析暴力抗法的成因。主要通过城管制度方面,政府方面,公安保障方面,执法机关及执法者方面,还有被管理者方面的原因进行分析。第五部分是对暴力抗法解决途径的意见提出。通过宏观、中观、微观三方面提出解决办法。希望本论文对城市管理执法工作起到现实指导意义,从而改进管理方法,减少暴力抗法现象,让城市管理和执法工作走上规范化、法治化道路,使我们的城市更和谐。 【英文摘要】Since China began a pilot of the urban administration integrated law enforcement in 1997, fourteen years has gone through and the integrated law enforcement has been forwarded to the whole country from the pilot at those years.
