中文摘要中文摘要 中文摘要 中文摘要 夫妻债务是夫妻财产制度的重要内容，在婚姻关系解除之时对离婚债务进行 清偿，成为离婚财产效力不可或缺的一部分。在现实生活中，离婚债务清偿早已 存在，而且随着夫妻参与交易活动的数量增加变得越来越复杂。域外立法对离婚 债务清偿设定了详细的规则，保证了离婚债务清偿的有序进行。虽然我国婚姻法 也对离婚债务的性质认定与清偿规则作出了原则性的规定，但是存在着立法过于 简略、分散、协调性不足等问题。对我国的离婚债务清偿制度加以完善以满足离 婚债务清偿的现实需要，已经刻不容缓。 本文首先在对离婚债务清偿涵义和特征界定的基础上，分析了离婚债务清偿 的行使规则和离婚债务清偿中的利益考量。接着对德国、法国、意大利、葡萄牙 和美国对离婚债务清偿的规定进行了介绍，并对其分析与总结，探讨可借鉴之处。 最后在对我国离婚债务清偿立法进行检讨的基础上，提出了完善我国离婚债务清 偿制度的立法建议。 关键词：离婚债务；性质认定；清偿规则；立法完善 万方数据 黑龙江大学硕士学位论文Abstract 黑龙江大学硕士学位论文 Abstract Marital debt is important part of the matrimonial property regime，when the marriage is dissolved，debt settlement has become integral part ofthe effectiveness of property．In real life，divorce debt service already exists，but with the increase in the number of couples involved in trading activities，it becomes increasingly complex． Extraterritorial legislation on divorce debt settlement set up detailed rules to ensure the orderly conduct of the divorce debt settlement．Although China’S Marriage Law also identified the nature of the divorce debt settlement rules and regulations in principle，but it is too brief in legislation，decentralization，lack of coordination and other issues．It has been pressing in our divorce debt settlement and the perfect for debt settlement systems to meet the practical needs of divorce。 Firstly,in this article，based on the meaning of divorce debt settlement and characteristics defined，we analysis the rule ofthe debt settlement exercise divorce and the interest considerations in divorce debt settlement rules．Following we introduce， analysis and summary to explore learn from divorce debt settlement through Germany,France，Italy,Portugal and the United States．Finally,based on our review of the divorce debt settlement legislation，we proposed many legislative proposals on the debt settlement system of divorce． Keywords：divorce debt；nature finds；solvency rules；Legislation -Il- 万方数据 目 目 录 目 录 中文摘要 I Abstract ·II 绪论 ··1 一、研究的目的和意义 1 二、文献综述 2 三、文章结构 5 第一章离婚债务清偿概述 ·7 第一节离婚债务清偿的界定 ”7 一、离婚债务清
