胎儿利益的民法保护 （硕士论文摘要） 传统民事权利理论认为，自然人的权利能力始于出生，终于死亡。故而，胎儿不具有民事权利能力，不属于受民法保护的民事主体范围，这已成为法学理论界的定论。然而，胎儿是自然人生命发育的必经阶段，保护胎儿利益是对自然人权利提供全面保护的必然要求,其重要性毋庸置疑。自上世纪50年代以来，随着侵害胎儿利益案件的不断增多和人们观念的改变，要求保护胎儿利益的呼声日益高涨。 当然，随着时代的发展，世界各国都纷纷加强了对胎儿利益的保护，无论是保护手段还是保护范围，都取得了不容忽视的进步。相比之下，我国法律对胎儿利益的保护极其薄弱，缺陷明显，只有《继承法》第28条这区区一个条文对胎儿利益有所涉及。立法的缺失致使司法实践中审理胎儿利益受损的案件时根本无法可依，胎儿利益无法得到有力保护。因此，研究胎儿利益的民法保护问题就显得尤为重要和迫切。 本文运用了比较分析、理论分析的方法，分五部分对胎儿利益民法保护问题进行讨论: 第一章：胎儿的概念及胎儿利益。对胎儿的概念进行界定，并在此基础上分析胎儿可得享有的利益范围以及对这些利益提供保护的必要性。 第二章：保护胎儿利益的理论基础。通过对各种学说进行介绍和分析，得出应将人身权延伸保护说和侵权责任说共同作为胎儿利益受民法保护的理论基础的结论。 第三章：胎儿利益保护的立法模式。通过对各主要国家的立法模式的介绍和分析，得出应该淡化立法模式之间的天然隔阂，将“实用性”作为选择立法模式的第一准则的结论。 第四章：我国胎儿利益保护的现状。笔者对胎儿利益保护的立法缺失和司法现状进行了全面分析，为重构胎儿利益保护体系做铺垫。 第五章：重构我国的胎儿利益保护体系。首先，重构我国胎儿利益保护的理论基础，以人身权延伸保护说和侵权责任说相结合作为理论基础；其次，重构我国胎儿利益保护的立法模式，一方面，对监护制度作必要变通以保护胎儿原始利益，并以《继承法》第28条的立法方式规定胎儿可以享有的利益范围；另一方面，以侵权制度对胎儿的救济利益进行保护。 [关键词] 胎儿利益 保护 理论基础 立法模式 重构 Civil Law Protection of Fetal Interests (Abstract) According to the customary theory of capacity for civil rights, capacity for civil rights of a natural person begins with born and ends with death. So, it is almost an accepted conception in circle of our legal experts and specialists that fetus does not have capacity for civil rights and does not belong to the civil subjects protected by law. But fetus is an indispensable stage the natural persons must experience in the course of life development. To protect fetal interests is an inevitable requirement for overall-protecting natural person’s rights. The importance of protecting fetal interests is unquestionable.
