The text we will talk about below simply assesses the history origin of mental hurt indemnity，analyzes the concrete implication、the characters 、inscape of the mental hurt indemnity and simply dissertates the basic principles and element of mental hurt indemnity quantity our country has made，and I hope through the research of the text I can later offer some help which is good for perfecting our country law about the protection of human rights，enhancing the civil legislation and supplying the gap of legislation and justice. key phrase：mental hurt，mental indemnity，indemnity quantity 。其含义包括以下几个方面： ?从我国法律来看，对因侵害合同债权、物权、甚至身份权所导致的精神痛苦，并不允许受害人获得精神赔偿。只有当公民的人格权如生命健康权、姓名权、名誉权、肖像权、人格尊严、自由、隐私权、贞操权等受到不法侵害之时，才有权主张精神赔偿。对此，《最高人民法院关于审理名誉权案件若干问题的解答》第10条规定：“公民、法人因名誉权受到损害要求赔偿的，侵权人应当赔偿侵权行为造成的经济损失；公民并提出精神损害赔偿要求的，人民法院可根据侵权的过错程度、侵权行为的具体情节、给受害人造成的后果等情况酌定。” ?这不仅使公民的人格权保护有了有力的法律保障，为受害者主张精神损害赔偿提供了法律依据，也为司法实践审理精神损害赔偿案件提供了法律依据?在对公民人格权的不法侵害中，不仅会造成受害人财产利益的损失，而且往往会使受害人的精神生活受到极大伤害，产生生理上、心理上的精神痛苦，如愤怒、绝望、恐惧、不安、自卑等不良情绪，严重影响其正常的生活条件和生活环境，甚至使起丧失生存的信心和生活的乐趣，在对生命健康权的侵犯中这种损害结果更是常见的。虽然这种精神痛苦是受害人自身的感受和体验，但这种损害结果却是客观的，是显而易见的，它可以通过受害人的行为方式和生活习惯体现出来。而这种精神痛苦的客观实在性正是法官据以确认侵害人应承担精神损害赔偿责任和损害数额的具体依据。这种精神损害有时甚至远远大于造成的财产损失，如
