摘要医疗损害责任纠纷是近年来社会普遍关注的热点问题，而其中的举证责任分 摘要 医疗损害责任纠纷是近年来社会普遍关注的热点问题，而其中的举证责任分 配制度则是处理好医疗损害责任纠纷的关键。本文正是在这样的社会背景下，在 分析我国医疗损害责任诉讼举证责任分配制度的基础上，借鉴其他国家或地区的 相关理论及制度的优点，对完善我国医疗损害责任诉讼中的举证责任分配制度提 出了若干构想，希望能够通过这些努力寻求医方与患方的利益平衡点，促进我国 医疗卫生事业的健康发展。 本文共分为四章，各章内容如下： 第一章，阐述了举证责任和举证责任倒置的概念，晃定了医疗损害责任的概 念，从责任主体、行为主体、发生场合、责任性质和形态等五个方面阐述了医疗 损害责任的特征，概述了医疗损害责任诉讼中的举证责任分配制度的特殊性和合 理性。 第二章，在对美国、法国、德国、我国台湾地区、我国香港地区的医疗损害 责任诉讼中的举证责任分配制度进行考察的基础上，对上述几个国家和地区的医 疗损害责任诉讼中的举证责任分配制度进行了综合比较分析。 第三章，概括总结了我国医疗损害责任诉讼中举证责任分配制度的现状，对 其从积极作用和消极影响两个方面进行了评价，并就其存在的问题进行了分析。 第四章，在对我国医疗损害责任诉讼中举证责任分配制度进行分析和对其他 国家和地区相关制度考察的基础之上，提出了进一步完善我国医疗损害责任诉讼 领域举证责任分配制度的若干构想，以期以此促进我国医疗卫生事业的健康发 展。 关键词：举证责任医疗损害举证责任分配 中图分类号：D915．13 ABSTRACTWith ABSTRACT With the development of the medical treatment and public health system，the medical malpractice suit is a social nowadays of hot point problem，is also a judicial judgment to practice medium of point cnl】【problem．Burden of producing evidence is the key to the resolution of the medical malpractice suit．By discussing the basic theories about burden of producing evidence and the practice of the resolution of medical malpractice suits in foreign countries and other areas of our country,it tries to achieve a balanced allocation about burden of producing evidence between the medical institutions and the patients in this thesis．This thesis，with approximately 21，000 words，consists of four parts as shown below． Part I．Introducing the definition of the responsibility of medical damage，the concept of the allocation about the burden of proof and the concept of the allocation about the burden of proof in the lawsuit of medical damage Part H．Discussing the basic theories about burden of producing evidence and the practice of the resolution of medical malpractice suits in foreign countries and other areas of our country PartⅢ．Summarizing the current situation of the allocation about burden of producing evidence and the practice of resolution of medical malpractice suit in our country Part IV．Making suggestion
