摘 要 本文在总结超国家治理理论和欧盟电信业发展历史的基础上，将具体分析 欧盟电信业超国家治理的运作模式、影响和制约欧盟电信业超国家治理的各因 素，并对欧盟电信业超国家治理的效果和启示做出总体评估。在欧洲一体化早 期，电信业由于其传统的垄断地位和特殊的行业性质一直由各成员国政府主导。 然而在跨国间的经济贸易发展、人员的自由流动以及电信技术的革新等新形势 的推动下，从20 世纪80 年代后期开始，欧盟着手酝酿把电信业纳入其一体化 进程中，并主要从政策的制定和执行这两个层面促进了电信业领域的超国家治 理。在欧盟电信业超国家治理的过程中，由于能够更广泛地整合欧盟各层面的 电信利益以增强欧盟整体的电信竞争力和实现电信利益的最大化，并且能够对 于跨国行为体在跨国经济交换中不断产生的电信需求做出更加迅速的反应，超 国家性质的机构如欧盟委员会、欧洲法院和欧洲议会较之政府间性质的部长理 事会、欧洲理事会在诸如制定、解释并实施欧盟超国家电信政策方面发挥了更 为重要的作用，而其中欧盟委员会的作用尤为关键。在本文选用的四个相关案 例中，欧盟委员会在1987 年发表的首份电信绿皮书不仅标志着欧盟超国家电信 政策的出台，还引导了成员国电信改革的方向，代表了欧盟电信业超国家治理 达到了一个新阶段，而2007 年欧盟委员会提出的电信改革方案则表明了其进一 步寻求欧盟电信业超国家治理的目标。但由于欧盟电信业超国家治理遇到了种 种阻力，因此到目前为止欧盟电信业依旧是欧盟与成员国共享的政策领域，欧 盟电信业超国家治理的程度有限。但不可否认的是，其超国家治理模式已经取 得了一定的成效，其运行机制和动力具有丰富的内涵，可为其他国家和地区的 电信业改革提供有益的借鉴。 关键词：欧盟电信业；超国家治理 1 Abstract Based on summarizing theories of supranational governance and the history of telecommunications industry in the EU ，this thesis will analyze the operational model and effecting factors of supranational governance over the telecommunications industry in the EU and finally evaluate its effects and illumination for us. In the early time of European integration, the telecommunications industry had been dominated by every member state of the European Community because of its traditionally monopolistic status and special industrial character. However, with the development of transnational economy and trade, free movement of people, technical renovation of telecommunications and so on, EU has been setting about bringing the telecommunications industry into its integration process since the late 1980s, which indicates the start of supranational governance of telecommunications industry in the EU.
