公共管理视角下的我国缺陷产品召回制度现状和发展研究 摘 要 产品安全与公众的日常生活关系紧密，是公共安全的重要组成部分。缺陷 产品往往是成批量生产的，数量较大，一旦进入流通领域、分散到使用者手中， 如不加以干预，其潜在的危害是巨大的——这无疑是对公共安全的威胁及破坏。 建立完善的缺陷产品召回制度，可以保证在危害大规模出现之前，对流通 领域和使用者手中的缺陷产品进行合理的处置，以消除潜在的风险。这样，可 以最大程度维护消费者的人身、财产安全和正常的市场经济秩序。这不仅是政 府履行社会管理和公共服务职能的一项重要任务，也是提高公共安全保障水平、 构建和谐社会的必然选择。 从 2004 年至今的短短几年间，我国的缺陷产品召回制度经历了一个快速的 发展过程。无论是在法律法规、组织和监管、召回实施效果、企业自觉性和公 众认知度等各方面都取得了显著的进步。同时，我们应该看到，目前在我国缺 陷产品召回工作中，还存在着立法滞后、处罚力度不够、法规可操作性不强、 相关保险产品提供不足、专业团队和中介组织不够发达等诸多需要完善之处。 本文基于公共管理的视角，运用国内外相关资料，首先论述了我国缺陷产 品召回制度的发展现状和存在的突出问题。随后，尝试借鉴国外缺陷产品召回 制度的成功发展经验并充分结合我国实际情况，为我国缺陷产品召回法律制度 的进一步发展提供有益的对策和建议。 关键词：公共安全、缺陷产品、召回制度 公共管理视角下的我国缺陷产品召回制度现状和发展研究 ABSTRACT Product safety has a close tie with people’s daily life and is essential to the public safety. Due to the mass production, defective product usually sums up to a large quantity. Once the defective products come to the circulation area and reach hands of consumers, the potential damage to public safety could be huge. So, necessary measures are supposed to be taken to prevent this. To eliminate potential risk, it is necessary to establish a recall system of defective products before the risk escalates itself and handle with those products in the circulation area and in hands of consumers. Therefore, consumers’ personal and property safety can be ensured and the market order can be guaranteed to the largest extent. It is a main task that government executes its function of public administration and public service, it is an inevitable option to strengthen public safety level and build up a harmonious society.
