In view of the constitutional power properties, migration freedom has been written into different constitutions and international human rights conventions. China has had experience on civil migration protection for liberty , but it is cancelled due to some reasons such as economy, politics, ideology. With the establishment of the socialist market economy in our country and the social transformation and meticulous, people are creasingly in urgent need of rights. At the same time because of the need for build civil society in our country, returning migration freedom is imperative. What’s more, with the development of market economy, the fact of large-scale population flow, and the increasing ability of the reform of government and the public, it also creates conditions for the realization of the migration freedom.
