我国农地征收制度改革研究——以大连市为例 摘要 土地征收是当今世界各国普遍采用的一种土地制度。我国现行土地征收制度 形成于计划经济时期，对当时国民经济的发展起到了积极的作用。但随着社会主 义市场经济的逐步建立，我国城市化率的不断加快，其存在的一些内外缺陷正在 日益显现出来，土地征收补偿问题也已逐渐成为影响我国农村经济发展和社会稳 定的重大问题。各地因征地引起的社会矛盾越来越突出，特别是因征地造成的农 民生活水平下降、就业无着落等问题日益严重，己成为影响社会长治久安的重要 因素之一，也成为建设和谐社会的障碍。大连市经济发展迅速，处于经济发展前 沿地带，地少人多，人地矛盾突出，土地征收问题突出，具有典型意义。本文研 究目的是通过研究大连市土地征收的相关政策及做法，窥一斑而见全貌，为我国 土地征收制度的完善提供一些意见。 本文首先对征地补偿的基本概念进行界定，然后分析征地补偿的条件、特征，阐 述我国征地的立法现状。其次，在阐述大连市征地政策基本现状的基础上,从征 地主体、征地条件、补偿范围与补偿方式等方面来分析大连市征地补偿存在的问 题。接下来本文分别对土地征收各个方面的国内外先进做法进行总结，包括土地 征收的条件、土地征收的程序及土地征收的补偿等，为构建我国合理完善的土地 征收制度提供借鉴；提出完善我国土地征收条件、征收程序、征收补偿的建议， 对于合理解决大连市及我国土地征收补偿问题具有重要的现实意义，这也是本文 的创新点。 关键词：土地征收 大连市 公共利益 征收程序 征收补偿 4 ABSTRACT Land acquisition is widely used around the world today a land system. Chinas current land acquisition system in a planned economy period, the national economy at that time played an active role. But with the gradual establishment of a socialist market economy, Chinas accelerating urbanization, the existence of a number of internal and external defects are increasingly apparent, the issue of compensation for land expropriation has become affected rural economic development and social stability of major problems.
