土地征收与失地农民利益保障问题 吴芳芳 (首都经济贸易大学 硕士研究生) 摘 要：在城市化进程中，农村集体土地大量被征收，大量农民成为失地农民。现行的征地标准过低且方式单一，导致大量失地农民生活窘迫，其结果必然会影响到社会的安定。妥善安置失地农民，是我国社会发展的一个不可忽视的问题，建立失地农民社会保障体系不失为解决上述问题的一个可行方案。本人从土地征收的内涵以及土地征收过程中存在的问题入手，提出要切实做好征地工作，保障失地农民的应有利益。 关键词: 土地征收 失地农民 失地农民利益保障体系 Land expropriation and land-lost farmers interests security Fangfang - wu (The Capital University of Economics and Business Postgraduate ) Abstract: In the process of urbanization, as the quickening pace of the rural collectively-owned land expropriation, plenty of peasants become landless peasants. The standard of current land expropriation is too low, and in a single way, resulting in a large number of land-lost farmers suffering a distress life, the consequence will inevitably affect the social stability. Properly arrange land-lost peasants, is a problem that cann’t be ignored in the social development of our country, the establishment of land-lost farmers social security system would be a viable solution. Taking the connotation of land expropriation and the existing problems in the process of land expropriation as a start, put forward a good job we need to do in land security interests of land-lost farmers. Key words: Land expropriation Land-lost peasants The land-lost farmers interests security system 土地征收的内涵 1、土地征收的概念 土地征收是指国家为了公共目的或公共利益需要, 依照法定程序, 强制性地取得原土地权利人的土地权利, 并给予经济补偿的行政行为（简称征地）。 在不同国家乃至同一个国家的不同历史时期，土地征收的说法不完全相同，比如英国法律称之为土地强制收买或强制取得，法国法律称之为土地征收，日本法律称之为土地收用。其实质都是国家或政府在特定条件下对土地的强制性购买，它并不属于一般土地交易的范畴。 2、我国土地征收的法律规定 在我国目前条件下，土地征收是指国家为了社会公共利益的需要，依法将农民集体的土地变为国有，并依法给予补偿的法律制度。 《宪法》规定，国家为了公共利益的需要，可以依照法律规定对土地实行征用。2004年宪法修正案指出国家为了公共利益的需要，可以依照法律规定对公民的私有财产实行征收或者征用，并给予补偿。目前我国的征地补偿是按照被征收土地的原用途给予补偿。《土地管理法》第22条：国家建设征用土地，建设单位应支付土地补偿费、青苗和附着物补偿费、安置补助费。 （1）土地补偿费 a、征用耕地、蔬菜地，根据国家规定的价格政策，按该土地征用前三年平均年产值(下同)的六倍计算;b、征用鱼塘、藕塘、养殖场、果园、竹园、林地等土地，按该土地年产值的五倍计算;c、征用柴山、滩地、水塘、苇塘和其他有收益的非耕地，按该土地年产值的三倍计算;d、征用宅基地按邻近耕地的补偿标准计算;房屋由建设单位另行征地移迁重建的，原宅基地不再给予补偿; e、征用无收益的非耕地，一般不予补偿。 （2）青苗和附着物补偿费 a、青苗补偿费，一般按一季农作物的产值计算;能收获的不予补偿。多年生经济林木，可以移植的，由
