中文摘要 近年来我国多次发生重大食品安全事故，使民众对我国的食品安全与卫生问题产生了巨大的质疑和危机感，食品安全问题已成为目前公共健康最主要威胁之一。每年大量食品安全事件的出现，暴露了我国在缺陷食品管理方面的低效和无序。本文首先提出完善食品召回制度的意义，通过分析食品召回过程中侵害消费者合法权益的现象，指出目前我国食品召回制度的诸多缺陷。针对这些缺陷，提出完善我国食品召回制度的具体措施。以期强化食品生产企业对食品安全的责任和义务，切实保障消费者的健康和合法权益，规范食品市场秩序。 关键词：食品召回；缺陷；食品安全标准；溯源制度 Abstract In recent years, our country had the significant food safety incident many times, caused the populace to our country’s food the safety and health problem which has had the huge question and the crisis feeling, the food security problem has become one of the most main threats of present public health. Every year the massive food security incident’s appearance has exposed our country in the flaw food management aspect with low efficiency and the disorder. This article first proposed that food recalls system’s significance to consummation, through analyzing the phenomenon that in food recalls the process to violate the consumer rights and interests, pointed out that at present our country food recalls systems many flaws. In view of these flaws, proposed that consummates our country food to recall system’s specific measures. By the time enriched food production enterprise to food securitys responsibility and the duty, safeguards the consumer health and the rights and interests earnestly, standard food market order. Key words: food recall；flaw；food safety standards；traceability system 试论我国食品召回制度的完善 食品召回是指食品生产经营企业在获悉食品存在可能危及消费者健康安全的缺陷时，依法向政府部门报告，及时通知消费者，并从市场和消费者手中收回缺陷食品。食品召回最大限度地避免或减少流入市场的缺陷食品对公众的健康损害，以维护消费者的合法权益。目前该制度在欧美发达国家日趋完善，而在我国则刚刚起步。作为一项防患于未然的制度，虽然在《中华人民共和国食品安全法》里有明确的规定，但是该规定过于原则，缺乏操作性。因此通过借鉴国外成功的经验和做法，结合我国国情不断完善我国的食品召回制度，这是当前一项重要的工作。 一、完善我国食品召回制度的意义 随着经济全球化的发展以及人口、环境、资源可持续发展战略的推进，中国食品安全监管工作面临着新的形势与挑战。“苏丹红”、“孔雀石绿”、“果冻”、“丙烯酰胺”、“三聚氰胺”等一系列食品安全事件更加凸显了加快完善中国食品安全监管制度的紧迫性和必要性。食品召回制度作为食品安全控制体系中不可或缺的组成部分，是食品安全监督管理的重要手段。它可以迅速收回市场上的缺陷食品从而有效地消除食品安全危害。近年来我国相继出台的一系列与食品安全有关的规定和措施起到了一定的积极作用，但并无法杜绝消费者合法权益受损害的情况。作为食品安全监管的保护神，食品召回制度的进一步完善十分必要。 （一）有利于保护消费者的合法权益 食品与每个人息息相关，其质量问题直接关系到消费者人身健康甚至生命安全。市场上需要被召回的食品主要以可能或
