PAGE  本科生毕业论文(设计) 论文题目:我国就业歧视及其治理途径姓名: 徐达学号:014409213883专业:人力资源管理学院:公共管理学院指导教师:完成时间:2011年3月 日 我国的就业歧视及其治理途径 徐达 2011 年 3 月 日 摘  要 就业歧视在中国是一个长期存在的复杂问题,如何有效地治理就业歧视是一个值得人们探讨和急需解决的实际问题。目前我国的就业歧视现象日益凸现并受到社会的广泛关注,我国现有法律对于就业歧视的规定不够完善、缺乏可操作性,有必要制定专门的反就业歧视法予以完善。 本文集中阐述了就业歧视的相关概念及内涵,围绕就业歧视所带来的社会问题做了相应的分析。我国日前反就业歧视立法尚不完善,理论研究也不够充分,本文在对就业歧视概念界定的基础上,探讨了中国目前的就业歧视法律制度存在的不足,提出了个人对完善就业歧视法律制度的建议。 本文系运用规范研究方法进行的专题研究。全文分4个部分:首先是讨论了就业歧视的概念及其表现形式以及市场经济中的差别对待是否等同于就业歧视;其次是从经济法的角度对就业歧视问题所体现出的市场调节失灵和政府管制缺陷的两难境地进行了分析,同时对如何运用经济法这一解决机制来解决就业歧视问题进行了分析;最后结合美国反歧视法的实践,得出了对于我国反歧视立法的一些有益启示。 关键词:就业歧视;经济法解决机制;反就业歧视法;经济学 Abstract Employment discrimination in China is a long-standing complex issues, how to efficiently deal with discrimination in employment is a worthy discussion and practical problems need to be resolved. At present, Chinas employment discrimination has become more apparent and widespread concern by the community, our existing legal requirements for employment discrimination is not perfect, the lack of operability, it is necessary to develop specific anti-employment discrimination laws to be perfect. This article focuses on the concepts of employment discrimination and content, discrimination in employment around the social problems caused by doing the appropriate analysis. Chinas recent anti-employment discrimination is not perfect, theoretical research is not sufficient, the paper defines the concept of discrimination in employment on the basis of employment discrimination in Chinas current shortcomings of the legal system, made a personal employment discrimination on the sound legal system recommendations. This paper studies the use of standardized methods of case studies.
