内 容 摘 要 内 容 摘 要 非婚生子女的法律地位及其权益保护是当前亲子关系立法中无法回避的一 “ ” 个重要问题。顺应 子本位亲子法 的发展趋势，现代各国法制普遍以子女最佳利 益为核心，切实保障非婚生子女的基本权益。本文从非婚生子女法律地位的历史 变迁入手，揭示非婚生子女立法的发展趋势，并分析比较当前不同国家和地区法 律的有关规定，试图从纵横两方面研究非婚生子女的法律保护问题。然后立足于 现实，针对我国现行非婚生子女立法的不足提出了相应立法构想。 全文除了前言和结束语外，共分四章。 前言指出我国非婚生子女的生存现状与现行非婚生子女法律保护机制的不 健全，说明强化对这一弱势群体法律保护的现实意义。 第一章非婚生子女概述。该章对非婚生子女的概念进行了界定，并通过考察 非婚生子女法律地位的历史演变得出结论，即以子女最佳利益为原则，切实保护 非婚生子女权益是当前亲子关系立法发展的必然趋势。 第二章非婚生子女法律保护的国际比较。该章以典型国家和地区的立法为 例，对外国现行法中与非婚生子女权益保护有关的制度进行比较分析，以期为完 善我国非婚生子女法律保护体系提供有益的参考。 第三章我国非婚生子女法律保护的现状分析。该章介绍了我国现行非婚生子 女权益保护的立法与司法实践，分析了我国在非婚生子女法律保护过程中存在的 问题。 第四章我国非婚生子女法律保护体系的完善。本章进一步论证了强化对非婚 生子女法律保护的必要性，并借鉴其他国家和地区的立法经验，对完善我国非婚 生子女法律保护机制提出若干具体设想。 结束语对本文总体思路加以回顾，并坦陈本文缺憾。 关 键 词：非婚生子女；亲子关系；法律保护 ABSTRACT ABSTRACT The legal status and the rights and interests protection for illegitimate children has been an unavoidable issue in recent parenthood legislation. According to the development trend of child-oriented parenthood law, most countries today are concentrating on the best interests of the child and trying to improve the conditions of illegitimate children. This thesis is to explore the legal protection of illegitimate children by the historical view and comparison with different countries.
