试论用尽当地救济原则

在WTO争端解决机制中的适用

摘要：用尽当地救济原则，又称用尽国内救济原则，是一项古老而又重要的习惯国际法原则，是传统国家责任法律的一部分，该规则长期以来得到了广大国际法学家的普遍赞同和各国实践、国际判例、国际组织的一致肯定。那么，用尽当地救济原则是否也应在WTO争端解决机制中适用呢?这一问题在WTO争端解决的实践中一直广受争议。另外，用尽当地救济原则是一项重要的习惯国际法原则，对其不能盲目的排斥或否定。我国在入世后，对于用尽当地救济原则的适用，应持客观、合理、现实、审慎的态度，我们必须利用WTO争端解决机制，由此就要求我们改变一贯做法，这必然会带来一系列挑战。本文将主要对用尽当地救济原则是否适用于WTO争端解决机制这一争议及我国如何利用用尽当地救济原则问题展开论述。

Abstract:exhaustionoflocalremedies,alsothenameexhauststhedomesticreliefprinciple,isanitemisancientbutthealsoimportantcustominternationallawprinciple,isatraditionalcountryresponsibilitylawpart,thisruleobtainedthegeneralinternationallawsscientistsuniversalapprovalandthevariouscountriespractice,theinternationallegalprecedent,theinternationalorganizationsconsistentaffirmationsincelongago.Then,exhauststhelocalreliefprinciplewhetheralsoshouldinTheWTOconflictsolvesinthemechanismtobesuitable?ThisquestioninTheWTOconflictsolvesinthepracticeisalwaysdisputed.Moreover,exhauststhelocalreliefprincipleisanimportantcustominternationallawprinciple,toitcannottheblindrepelorthedenial.OurcountryafterbeingWTOentry,regardingexhauststhelocalreliefprinciplebeingsuitable,shouldholdobjectively,isreasonable,realistically,thecarefulmanner,wemustsolvethemechanismusingtheWTOconflict,fromthisrequestsustochangetheconsistentprocedure,thiscanbringaseriesofchallengesinevitably.ThisarticlemainlytowillexhaustthelocalreliefprinciplewhetherwillbesuitableintheWTOconflictsolvesmechanismthisdisputeandourcountryhowusesexhauststhelocalreliefmatterofprincipletolaunch
